Terms of Service

1. Agreement

These Terms of Service are a contract between you and Bit Forge Ventures, LLC, a Georgia limited liability company (“we”, “us”). They govern your use of Baja Blitz — the website at bajablitzgame.com, the browser mini-games on it, the Baja Blitz mobile applications, and the Baja Blitz app on Reddit (together, the “Game”). By playing the Game or using the site, you accept these terms. If you do not accept them, do not use the Game.

When you play on Reddit you are also bound by Reddit’s own User Agreement and the rules of the subreddit you are in. Those are between you and Reddit; where they conflict with these terms, they govern your use of Reddit itself and these terms govern the Game.

2. Who may play

You must be at least 13 years old to use the Game. If you are under 18, you may use it only with the consent and supervision of a parent or legal guardian, who agrees to these terms on your behalf and is responsible for your use. If you are in the EEA or UK, you must additionally meet your country’s age of digital consent or have your guardian’s permission.

You may not use the Game if you are barred from doing so under the laws of the United States or your country of residence.

3. The Game is a prototype

Baja Blitz is in active development and parts of it are pre-release. Features appear and disappear, tracks and balance change, leaderboards may be reset, and saved progress may become incompatible between versions. Beta access, where offered, is at our discretion and may be withdrawn.

4. Your licence to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and play the Game for your own entertainment. No other rights are granted: we and our licensors keep all right, title and interest in the Game, including its code, artwork, models, sound, name and look.

You may stream or record your own play and share it, including for monetized channels, provided you do not present the Game as your own work or imply we endorse you.

5. What you may not do

You agree not to:

• cheat — including modifying the Game, using bots, scripts, automation or external tools to play or to influence a result;
• fabricate or tamper with results, or submit race data to our servers that was not produced by genuinely playing the Game;
• attempt to manipulate the leaderboards, including by generating player identifiers or Reddit accounts in bulk;
• reverse engineer, decompile or disassemble the Game, except to the extent that applicable law expressly permits it despite this restriction;
• copy, redistribute, sell, sublicense or host the Game or its assets;
• scrape or bulk-download the Game, our APIs, or the leaderboards, or use them in an automated way beyond ordinary play;
• probe, overload, disrupt or attempt to gain unauthorised access to our systems, or circumvent any rate limit or security measure;
• use the Game unlawfully, or to harass, defraud or harm anyone.

We may investigate suspected violations and take any action we consider appropriate, including removing results, resetting a leaderboard, or blocking access.

6. Leaderboards

On the website and mobile apps, boards are computed from stored race records and reset daily at midnight UTC. Driver names shown on them are generated automatically from your device’s random player identifier; a name resembling a real person is coincidence.

On Reddit, boards run per subreddit, keep your best result for each mini-game, and show your Reddit username. Beating the holder lets you promote your run to a challenge post, which our app account publishes naming you and your result, and which other players can race against. Posting a run makes it public on Reddit.

We may remove, correct, reorder, withhold or reset any entry or any entire board at any time, for any reason, without notice. Nothing about a leaderboard position creates any entitlement, prize or property.

7. Your progress and your data

On the website and mobile apps, your save file, settings and personal bests are stored on your device, not in an account on our servers. Clearing your site data, switching browsers or devices, using private browsing, or uninstalling the app will lose your progress permanently, and we cannot restore it. We do not back it up for you.

On Reddit, your best result for each mini-game is held on the server against your Reddit username, and follows that account.

Separately, we record every race you complete on our servers, including a full replay of your driving inputs. What we collect, why, how long we keep it and what rights you have is set out in the Privacy Policy. It is a notice we are bound by as a controller, not a term of this contract.

8. In-game items and currency

The Game may include virtual items, parts, currency or progression rewards. These exist only inside the Game, have no monetary value, are not your property, cannot be exchanged for money or anything of value, and may be changed, rebalanced, revoked or removed at any time. If we later offer paid content, additional terms will apply at the point of purchase, and purchases made through Apple or Google are refunded, if at all, under those stores’ policies.

9. Feedback

If you send us ideas, bug reports or suggestions, you grant us an unrestricted, perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose without obligation or compensation to you. Please do not send us anything you consider confidential.

10. Changes, suspension and termination

We may modify, suspend or discontinue the Game or any part of it — including the leaderboards and the servers that store races — at any time, with or without notice. We may suspend or terminate your access if you breach these terms or if we reasonably believe your use harms other players or us. You may stop using the Game at any time; that is your termination right.

The following survive termination: the ownership of the Game reserved to us in section 4 (though your licence to play it does not), and sections 7, 8, 9 and 11 through 17.

11. Disclaimers

THE GAME AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECT WILL BE CORRECTED, OR THAT ANY DATA, SAVE, RESULT OR LEADERBOARD ENTRY WILL BE PRESERVED, ACCURATE OR RECOVERABLE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BIT FORGE VENTURES, LLC AND ITS MEMBERS, OFFICERS AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, SAVED PROGRESS, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS, ON ANY THEORY OF LIABILITY, WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR TWENTY-FIVE US DOLLARS (US$25).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions the exclusions and limits above apply only to the extent permitted, and nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

13. Indemnity

You agree to indemnify and hold harmless Bit Forge Ventures, LLC and its members, officers and contractors from any claim, loss, liability, and reasonable legal fees arising out of your breach of these terms, your misuse of the Game, or your violation of any law or third-party right. This section does not apply to consumers where applicable law prohibits it.

14. Disputes, arbitration and class-action waiver

Read this section carefully — it affects how disputes are resolved.

14.1 Talk to us first

Before starting any formal proceeding, send a written description of the dispute and the relief you want to support@bajablitzgame.com. We will try to resolve it informally within 60 days. This step is a precondition to arbitration for both of us.

14.2 Arbitration

If we cannot resolve it, you and we agree that any dispute arising out of or relating to the Game or these terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in Georgia, or by telephone or video, or in your home county if you prefer. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court of competent jurisdiction.

14.3 Class-action waiver

You and we each waive the right to bring or participate in a class, collective, consolidated or representative action. An arbitrator may award relief only in favour of the individual party seeking it. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to all other claims.

14.4 Exceptions

Either of us may bring a claim in small-claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property or stop unauthorised access to our systems.

14.5 Your right to opt out

You may reject this arbitration agreement by emailing support@bajablitzgame.com with the subject “Arbitration Opt-Out” within 30 days of first accepting these terms. Opting out affects nothing else in these terms and will not be held against you.

15. Governing law, and consumer rights we cannot override

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Subject to section 14, the state and federal courts located in Georgia have exclusive jurisdiction, and you consent to their venue.

If you are a consumer in the EEA or the UK, none of the above deprives you of the protection of the mandatory law of your country of residence: you keep those statutory rights, and you may bring proceedings in the courts of your own country. EU consumers can also use the European Commission’s online dispute resolution platform. Section 14 (arbitration) does not apply to you where your local law does not permit it.

16. Apple and Google app stores

Where you obtain the Game from the Apple App Store, you acknowledge that these terms are between you and us and not Apple; that Apple has no obligation to provide maintenance or support; that if the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) and has no other warranty obligation; that we, not Apple, are responsible for any product liability, legal-compliance or intellectual-property claim relating to the Game; and that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a US embargo or designated as terrorist-supporting, and are not on any US list of prohibited parties. Equivalent terms apply to Google LLC for the Google Play Store.

The Reddit app is distributed by Reddit, Inc. These terms are between you and us and not Reddit; Reddit has no obligation to provide maintenance or support for the Game, and we, not Reddit, are responsible for any product liability, legal-compliance or intellectual-property claim relating to it. Reddit may remove the app, a post or a subreddit at any time under its own rules.

17. General

These terms are the entire agreement between us about the Game, and supersede any earlier version of them. The Privacy Policy is referred to throughout and is binding on us as a data-protection notice, but it is not one of these terms. If any provision is held unenforceable, it is limited or severed and the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them to an affiliate or in connection with a merger or sale of assets. We may update these terms, and will change the effective date above; material changes will be announced in the Game or on the site, and continuing to play after they take effect means you accept them.
